چکیده

یکی از عوامل و اسباب لازم در مدیریت حریم جاده، قوانین و مقررات مربوطه است که در صورت عدم وجود آن این ناحیه از منظر محیط زیست دچار چالش‌های جدی خواهد شد. شناخت قوانین حریم جاده از آن جهت در پژوهش حاضر مورد بررسی قرار گرفت که برخی آشفتگی‌ها و نابسامانی‌های موجود در اکوسیستم کنار جاده، ناشی از قوانین و مقررات بوده و چه بسا به دلیل تدوین قوانین غیرجامع با مجریان متعدد، آسیب‌های پیچیده‌ای در فضای حریم راه ظاهر گردیده است. به این منظور در این مقاله از روش تحقیق کیفی و مطالعات کتابخانه‌ای به منظور بررسی و شناخت قوانین حقوقی موجود در حریم جاده استفاده شده است. همچنین با استفاده از روش نمونه‌گیری هدفمند، از ساکنین پنج روستای اطراف جاده کوهی خیل به بهنمیر 36 مورد مصاحبه در غالب گروههای 5 نفره انجام شد. مجموع این اطلاعات مورد تجزیه و تحلیل قرار گرفت. نتایج حاصل از این تحقیق نشان داد که تنوع موضوعی قوانین، اعمال قوانین توسط مجریان متعدد، عدم تعریف نظام مدیریت و بهره‌برداری از پوشش گیاهی حریم جاده، ضعیف بودن ماهیت موضوعی قوانین مربوطه از دیدگاه زیست‎محیطی مهمترین چالش‌های موجود در نحوه مدیریت ناحیه مذکور می‎باشد. همچنین چرای بدون مجوز و سهم 8 درصدی پوشش گیاهی حریم راه در تأمین علوفه دامداران محلی ساکن در حریم جاده، نشان‎دهنده عدم نظارت مناسب سازمان‎های ذیربط و در نهایت بهره‌برداری بی‎رویه در اکوسیستم‌ حاشیه جاده می‎باشد.

Investigating the Way of Managing Vegetation in Roadside (Case Study; Edge of Kouhikheyl-Behenmir Road)

چکیده [English]

One of the factors and tools necessary in managing roadside is rules and regulations without which, the area will face serious challenges in terms of the environment. Recognizing rules of roadside was investigated in the current research, since some perturbations and irregularities related to the ecosystem of roadside are the results of rules and regulations and also complex damages appeared in privacy of the roads due to incomprehensive rules with several executives. So in this research, qualitative research method and library studies are used in order to investigate and recognize legal rights present in privacy of roads. Also using targeted sampling method, 36 members of five villages were investigated in 5-person groups who were the residents of area near the road of Kouhikheyl to Behenmir. The total of the data were analyzed. The results showed that diversity of legislations, imposing legislations by various executives, lack of defining management system and exploiting privacy roadside vegetation, weakness of laws from the environment point of view are the most important challenges in the way of managing the mentioned area. Also sheep grazing without authorization and 8-percent portion of privacy road vegetation in providing local livestock forages indicate lack of supervision of organizations which finally leads to unlimited exploitation in roadside ecosystem.
